Welcome to Endgame! This End User License Agreement ("Agreement") is a binding agreement between you ("User" or "you") and Endgame App Holdings, LLC ("Company" or "we"). By downloading, installing, or using the Endgame application (the "App"), you agree to be bound by the terms of this Agreement.
2. License
2.1 Grant of License: The Company grants you a limited, non-exclusive, non-transferable, revocable license to use the App for personal, non-commercial purposes, subject to the terms and conditions of this Agreement and the App Store Terms of Service.
2.2 Restrictions: You shall not:
Copy, modify, or distribute the App.
Reverse engineer, decompile, or disassemble the App.
Remove, alter, or obscure any proprietary notices in the App.
Use the App for any commercial purposes without prior written consent from the Company.
3. Intellectual Property
The App and all related content, including but not limited to software, images, text, and other materials, are the property of the Company and are protected by intellectual property laws. You agree not to infringe upon these rights.
4. Privacy
Your use of the App is also governed by our Privacy Policy, which can be found at endgame.dating/privacy. By using the App, you consent to the collection and use of your information as outlined in the Privacy Policy.
5. Termination
This Agreement is effective until terminated by either party. You may terminate this Agreement at any time by deleting the App from your device. The Company may terminate this Agreement at any time without notice if you violate any terms of this Agreement. Upon termination, you must cease all use of the App and delete all copies from your device.
6. Disclaimer of Warranties
The App is provided "as is" and "as available" without warranties of any kind, either express or implied. The Company does not warrant that the App will meet your requirements, be uninterrupted, or error-free.
7. Limitation of Liability
To the maximum extent permitted by law, the Company shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits or revenues, whether incurred directly or indirectly, or any loss of data, use, goodwill, or other intangible losses, resulting from:
Your use or inability to use the App.
Any unauthorized access to or use of our servers and/or any personal information stored therein.
Any interruption or cessation of transmission to or from the App.
Any bugs, viruses, trojan horses, or the like that may be transmitted to or through our App by any third party.
8. Governing Law
This Agreement shall be governed by, and construed in accordance with, the laws of [Insert Jurisdiction], without regard to its conflict of law principles. You agree that any disputes, claims, or actions arising out of or relating to this Agreement shall be resolved in the appropriate courts located in [Insert Location] and you consent to the exclusive jurisdiction and venue of such courts.
In the event that any provision of this Agreement is deemed invalid or unenforceable, the remaining provisions shall continue in full force and effect.
9. Objectionable Content
Endgame is committed to providing a safe and welcoming environment for all users. We maintain a strict zero-tolerance policy towards any form of objectionable content, including, sexually explicit material, hate speech, harassment, abusive behavior and unlawful activity. Any user found engaging in such conduct will face immediate action, which may include account suspension or permanent bans. We take these matters seriously to ensure that everyone can enjoy a respectful and supportive community. Our team continuously monitors the platform to uphold these standards and is dedicated to swiftly addressing any violations.
Endgame utilizes built-in technology that automatically flags inappropriate and or objectionable content. Additionally, users have the ability to flag and report inappropriate and or objectionable content or activity for immediate review and action by Endgame. Any inappropriate and or objectionable content will be removed from the platform immediately.
10. Removal of User Data and Accounts
At Endgame, we are committed to respecting your privacy and ensuring that your personal data is handled with the utmost care. If you choose to delete your account, all personal information associated with it will be permanently removed from our platform, including your profile, photos, messages, matches and any other data we may have collected. Additionally your subscription will be canceled. Please note that it may take up to 24 hours for all traces of your account to be fully erased from our systems. Additionally, your subscription will be cancelled. Once your account is deleted, it cannot be recovered. If you have any concerns about your data or need assistance with the deletion process, our support team is available to guide you through the steps at admin@endgameapp.com
11.Account Subscription and Renewals
Your subscription will automatically renew at the end of each monthly billing cycle unless canceled. To avoid being charged for the next cycle, please cancel your subscription before the renewal date. You can manage or cancel your subscription anytime through your account settings.
12. Amendments
The Company reserves the right to modify this Agreement at any time. We will notify you of any changes by posting the new Agreement on our App. You are advised to review this Agreement periodically for any changes. Your continued use of the App after any modifications will constitute your acknowledgment of the modifications and your consent to abide by and be bound by the modified Agreement.
